Legally Binding Trailer Rental Agreement & Card Authorization for Motherload Trailer Rentals.
This Trailer Rental Agreement ("Agreement") is entered into between Mother Load Trailer Rentals ("Owner") and the undersigned renter ("Renter"). By reserving, accepting, or using any trailer from Owner, Renter agrees to be legally bound by all terms below.
1. Rental & Use
Renter rents the trailer and all associated equipment strictly at Renter's sole risk. Renter represents and warrants that they are experienced, capable, and legally authorized to tow, load, secure, and operate the trailer. All loads must be lawful, properly secured, and within rated capacities.
2. Rental Period
Rental shall not exceed thirty (30) consecutive days unless expressly approved in writing by Owner. Failure to return the trailer when due constitutes unauthorized possession.
2A. Reservation & Cancellation Policy
Renter acknowledges that Owner removes the trailer from availability and may decline other rental opportunities upon booking. Therefore, all reservations are final. No cancellations, refunds, credits, chargebacks, or rescheduling requests will be accepted once a reservation is confirmed, regardless of weather, changes in plans, scheduling conflicts, vehicle issues, failure to pick up the trailer, early return, or any other reason. Any exception shall be solely at Owner's discretion and must be made in writing. Renter expressly agrees that all rental payments are non-refundable once the reservation is booked.
3. Assumption of Risk & Liability Waiver
Renter knowingly and voluntarily assumes all risks of loss, theft, damage, injury, or death arising from possession or use of the trailer. Owner disclaims all warranties, express or implied, and shall not be liable for any direct, indirect, incidental, or consequential damages.
Hold Harmless & Indemnification
4. Indemnification
Renter shall defend, indemnify, and hold harmless Owner, its members, managers, employees, and agents from any and all claims, demands, damages, losses, causes of action, fines, penalties, costs, and attorney fees arising out of or related to this Agreement or the use, misuse, or possession of the trailer.
5. Authorized Drivers
Only drivers specifically listed on this Agreement are authorized to tow the trailer. All authorized drivers must be at least twenty-five (25) years old and properly licensed. Use by any unauthorized driver constitutes a material breach and voids permission to operate the trailer.
6. Hitching & Connection Responsibility
Renter is solely responsible for proper hitching, coupling, safety chains, breakaway cable, electrical connection, and load distribution. Owner makes no representations regarding hookup once the trailer leaves Owner's premises.
7. Condition, Damage & Return
Renter accepts the trailer in good condition and agrees to return it in the same condition received, ordinary wear excepted. Renter is responsible for all loss, theft, damage, tire failure, mechanical issues, misuse, or neglect occurring during the rental period.
8. DOT & Legal Compliance
Renter bears sole responsibility for compliance with all federal, state, and local laws including DOT regulations. Owner makes no guarantee of compliance after connection to Renter's vehicle.
9. GPS Tracking & Tampering
Trailer may be equipped with GPS tracking. Renter consents to monitoring for theft prevention and recovery. Any tampering, disabling, shielding, or removal of GPS equipment constitutes a material breach and will result in a minimum $1,500 fee plus all recovery costs.
10. Presumption of Theft
If the trailer is not returned within seventy-two (72) hours of the agreed return time and no written extension exists, Owner may deem the trailer stolen and report it to law enforcement. Renter remains financially responsible until recovery.
11. Winch Use Disclaimer (If Equipped)
Winch use is inherently dangerous. Renter assumes all risk including cable failure, snapback, shifting loads, injury, or death. No training or supervision is provided.
12. Late Returns
Late returns may incur additional rental fees, administrative charges, and up to 150% of the daily rate.
13. Abandonment & Recovery
Renter is responsible for all towing, storage, administrative fees, and recovery costs including $5.00 per mile one-way.
14. Insurance
Renter must maintain adequate liability and property damage insurance. Owner provides no insurance coverage.
15. Security Deposit, Card Authorization, Tolls, Violations, Fees & Charges
Renter authorizes Owner to charge any credit card, debit card, or other payment method provided for all rental charges, rental extensions, late fees, damages, loss, theft, tire damage, cleaning fees, fuel charges (if applicable), towing charges, storage fees, fines, citations, tolls, toll-by-plate charges, administrative fees, recovery costs, collection costs, attorney fees where permitted by law, and any other amounts owed under this Agreement.
Renter is solely responsible for all tolls, toll-by-plate charges, traffic violations, red light camera violations, school zone speed camera violations, parking tickets, citations, civil penalties, fines, bridge tolls, highway tolls, express lane charges, and any other fees, penalties, or charges arising from the use, towing, parking, possession, or operation of the rented trailer during the rental period, whether issued to the towing vehicle, the trailer, or based on the trailer license plate. This includes, without limitation, SunPass, Toll-By-Plate, license plate toll charges, bridge tolls, highway tolls, express lanes, parking enforcement, automated traffic enforcement systems, and any related penalties, late fees, or administrative charges.
If Owner receives any toll invoice, violation notice, citation, fine, penalty, administrative charge, or collection notice after the trailer has been returned, Renter remains fully responsible for reimbursement and expressly authorizes Owner to charge the payment method on file for the full amount owed plus an administrative processing fee of $25.00 per occurrence, or the actual administrative cost incurred by Owner, whichever is greater.
This authorization shall survive the termination of this Agreement and may be enforced after the rental period ends for any delayed charges, toll notices, violations, damages, unpaid balances, or other amounts due under this Agreement. Renter acknowledges responsibility for all tolls, violations, citations, fines, and post-rental charges and expressly authorizes Owner to charge the payment method on file for such amounts.
16. Governing Law
This Agreement shall be governed by Florida law.
17. Entire Agreement
This Agreement constitutes the entire understanding and supersedes all prior agreements.
